1. Acceptance of Terms

By accessing and using PinBuilds ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

PinBuilds is a software-as-a-service platform that automates the creation of Pinterest content. We provide tools for generating images and text metadata using third-party AI models.

Bring Your Own Key (BYOK) Architecture: PinBuilds operates on a "Bring Your Own Key" model. You are required to provide your own API keys for third-party services (such as OpenRouter, Fal.ai, and Runware). You are solely responsible for:

• Managing and securing your API keys.
• Paying any usage fees directly to these third-party providers.
• Adhering to the terms of service of these third-party providers.

3. Data Retention and Deletion

We prioritize user privacy and data minimization.

7-Day Retention Policy: We aim to be a transient processing layer, not a storage provider. All generated content (including images, text, and associated metadata) is stored on our servers for a maximum of 7 days to strictly facilitate your workflow (e.g., downloading CSV exports). After this 7-day window, data is automatically and permanently deleted from our databases. It is your responsibility to download or export your content within this timeframe.

4. User Accounts and Eligibility

To use PinBuilds, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into a binding contract.
• Provide accurate and complete registration information.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

5. Intellectual Property Rights

Your Content: You retain all rights to the input you provide to the Service and the output ("Generated Content") produced by the Service to the extent permitted by law.

Our License: By using the Service, you grant PinBuilds a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your Content solely for the purpose of providing and improving the Service (e.g., generating the pins you requested). This license expires when your content is deleted from our systems (after 7 days).

6. Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To generate content that is sexually explicit, hateful, harassing, or violent.
• To infringe upon the rights of others, including copyright, trademark, privacy, or publicity rights.
• To generate spam or fraudulent content.
• To reverse engineer, decompile, or disassemble any aspect of the Service.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Limitation of Liability

In no event shall PinBuilds, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
